About us and these Terms
Silver Steps is a manufacturer and supplier of ladders and access solutions, based at 346, Shivaji Kutir Mandal, next to LIVEON Plywood, L.B.S. Marg, Kurla (West), Mumbai 400070, Maharashtra, India (GSTIN 27BORPK5626N1Z5). These Terms apply alongside our Privacy Policy. We may update these Terms at any time by posting a revised version on this page; the version in force at the time of your order applies to that order.
Nature of the Website - information, not an offer
The Website presents our products and capabilities for information purposes. Product descriptions, images, dimensions, specifications, colours and weights are indicative and provided in good faith; minor variations may occur due to the manufacturing process, and images may not depict exact scale or finish. Nothing on the Website constitutes a binding offer to sell. A binding contract is formed only when we accept your order in writing (for example, by confirming a Purchase Order or issuing an invoice / order confirmation).
Enquiries, quotations and pricing
(a) We operate primarily on an enquiry-and-quotation basis. Prices are provided through a formal quotation on request.
(b) Unless expressly stated otherwise, all prices are exclusive of GST and other applicable taxes, and exclusive of freight, transport, insurance and installation.
(c) Quotations are valid only for the period stated on the quotation. Because raw-material costs can fluctuate, prices are subject to revision before a formal order is confirmed.
(d) Any typographical, clerical or pricing error is subject to correction; we are not obliged to honour an order placed on an obviously erroneous price.
Orders and payment
(a) Orders are confirmed against a Purchase Order and/or the payment terms stated on the quotation or invoice.
(b) Accepted payment methods and any advance-payment requirement will be stated on the quotation/invoice. We comply with limits on cash transactions under applicable Indian law.
(c) Title to goods passes only on receipt of full payment. Risk in the goods passes on dispatch/delivery as stated in clause 6.
(d) Late payments may attract interest and/or suspension of further supply, as permitted by law and as stated on the invoice.
Manufacturing and delivery timelines
(a) Dispatch and delivery timelines are estimates given in good faith and stated on the quotation/order confirmation. Standard items and custom fabrications have different lead times.
(b) Time is not of the essence unless expressly agreed in writing.
(c) Delivery, freight and transport arrangements and charges are as stated on the quotation. Risk passes to the buyer on dispatch/handover to the carrier unless otherwise agreed in writing.
Transit damage and shortages
Goods should be inspected on delivery. Any transit damage, shortage or discrepancy must be reported to us in writing at enquiries@silverstepss.com within the reporting window stated on your invoice/quotation, with supporting evidence (such as photographs and, where applicable, unboxing video). Remedies for verified transit damage are limited, at our discretion, to repair or replacement of the affected goods.
Returns, cancellations and custom orders
(a) Because our products are safety-critical access equipment, returns and cancellations are limited and are governed by the terms stated on your quotation/order.
(b) Custom-fabricated or made-to-order items are manufactured to your specification and cannot be resold to others; accordingly, they are non-cancellable and non-returnable once production has commenced, and advance amounts for custom work may be non-refundable to the extent of costs incurred.
(c) Nothing in this clause affects your rights in respect of goods that are defective (see clause 8) or any rights you have under applicable law that cannot be excluded.
Product warranty and manufacturing defects
(a) We warrant our products against genuine manufacturing defects to the extent and for the period stated in our quotation, invoice or product documentation.
(b) The warranty does not cover damage caused by misuse, overloading beyond the rated capacity, improper installation, accident, unauthorised modification, normal wear and tear, or failure to follow safety instructions.
(c) Our sole obligation for a valid warranty claim is, at our option, repair or replacement of the defective goods. This is your exclusive remedy for defective goods, to the extent permitted by law.
Safe use of products (important)
Ladders and access equipment can cause serious injury if used incorrectly.
You are responsible for selecting the right product for your task, inspecting it before each use, using it within its rated load capacity and intended purpose, and following all safety instructions and applicable workplace safety regulations. Aluminium and other conductive ladders must not be used near live electricity; use appropriately rated non-conductive (FRP) equipment for electrical work. Silver Steps is not responsible for injury, loss or damage arising from incorrect selection, misuse, overloading, poor maintenance, or use contrary to instructions or law.
Rentals (where offered)
Where Silver Steps offers products on rental or lease, the rental will be governed by a separate rental agreement setting out the rental period, charges, deposit, condition, insurance, and the renter's responsibilities for care, safe use and return of the equipment. The renter is responsible for loss of or damage to rented equipment beyond fair wear and tear.
Intellectual property
All content on the Website - including text, graphics, logos, product images, designs and layout - is owned by or licensed to Silver Steps and is protected by applicable intellectual-property laws. You may not copy, reproduce, republish or use it for commercial purposes without our prior written permission. “Silver Steps” and our logo are our marks and may not be used without permission.
Acceptable use of the Website
You agree not to misuse the Website, including by attempting to gain unauthorised access, introducing malicious code, scraping content at scale, or using it for any unlawful purpose. We may suspend or restrict access to anyone who breaches these Terms.
Third-party links and services
The Website may link to third-party sites or use third-party services (such as WhatsApp, mapping and analytics). We are not responsible for the content, policies or availability of third parties, and your use of them is at your own risk and subject to their terms.
Limitation of liability
(a) The Website and its content are provided “as is” and “as available”, without warranties of any kind except those that cannot be excluded by law.
(b) To the fullest extent permitted by applicable law, Silver Steps shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising out of or in connection with the Website, our products, or these Terms.
(c) To the fullest extent permitted by law, our total liability arising out of or in connection with any order shall not exceed the invoice value of the specific goods giving rise to the claim.
(d) Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold Silver Steps harmless from any claim, loss, liability or expense arising from your breach of these Terms, your misuse of our products, or your use of the Website in violation of applicable law.
Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, epidemic or pandemic, war, civil unrest, strikes, government action, power or raw-material shortages, or disruption to transport or communications networks.
Severability and waiver
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, the Website, or any order.
